تسري هذه الشروط والأحكام اعتباراً من 1 مارس 2026 ("تاريخ السريان"). وبمجرد دخولك إلى ProfileTap أو استخدامه، فإنك توافق على أن هذه الشروط والأحكام تُعد نافذة وملزمة لك بالكامل بدءاً من تاريخ السريان فصاعداً.

بمجرد الدخول إلى منصة ProfileTap، أو التسجيل فيها، أو استخدامها أو استخدام أيٍّ من خدماتها أو ميزاتها أو محتواها، فإنك تقر بأنك قد قرأت هذه الشروط والأحكام وفهمتها، وتوافق على الالتزام بها، بما في ذلك جميع السياسات المشار إليها. وفي حال عدم موافقتك على أي جزء من هذه الشروط، يتعين عليك التوقف فوراً عن استخدام المنصة.

تُعد ProfileTap منصة للهوية الرقمية تتولى تشغيلها شركة Vedanta Core، وتتيح للمستخدمين إنشاء ملفاتهم الشخصية أو المهنية وإدارتها ومشاركتها باستخدام بطاقات الاتصال قريب المدى (NFC)، ورموز الاستجابة السريعة (QR codes)، وروابط الملفات الشخصية القائمة على الويب. وتوفر المنصة أدوات وميزات صُممت لمساعدة المستخدمين على استعراض هويتهم الرقمية، والتواصل مع الآخرين، والوصول إلى الخدمات ذات الصلة بالملفات الشخصية والمتاحة ضمن المنصة. ويشمل استخدامك لـ ProfileTap إمكانية الوصول إلى الميزات فور إتاحتها؛ كما يحق لنا تقديم ميزات أو خدمات معينة، أو تعديلها، أو إيقافها في أي وقت دون إشعار مسبق. وبمجرد استخدامك للمنصة، فإنك توافق على الامتثال لجميع القوانين المعمول بها، وكذلك لهذه الشروط والأحكام التي تحكم استخدامك للخدمات.

للوصول إلى ميزات معينة في منصة ProfileTap واستخدامها، قد يُطلب منك التسجيل للحصول على حساب ("الحساب"). عند إنشاء حساب، فإنك توافق على تقديم معلومات دقيقة وحديثة ومكتملة، وذلك وفقاً لما يطلبه نموذج التسجيل، كما توافق على إبقاء تلك المعلومات محدثة باستمرار. أنت تتحمل المسؤولية الكاملة عن الحفاظ على سرية بيانات اعتماد حسابك (بما في ذلك كلمة المرور الخاصة بك)، وعن كافة الأنشطة التي تتم من خلال حسابك. وبمجرد تسجيلك للحصول على حساب، فإنك تقر وتتعهد بأنك قد بلغت السن القانونية اللازمة لإبرام عقد ملزم بموجب القوانين المعمول بها (وعادةً ما يكون ذلك عند بلوغ سن 18 عاماً على الأقل)، وبأنه لا يوجد ما يحظر عليك الوصول إلى المنصة أو استخدامها بموجب القوانين السارية، كما تقر بأنك تقدم معلومات صحيحة ودقيقة. وفي حال كنت تقوم بالتسجيل نيابةً عن شخص آخر أو كيان آخر، فإنك تقر بأنك مخول قانوناً للقيام بذلك، وبأن لديك الصلاحية لإلزام ذلك الشخص أو الكيان بالامتثال لهذه الشروط والأحكام. كما توافق على إخطارنا فوراً بأي استخدام غير مصرح به لحسابك، أو بأي خرق أمني آخر قد يطرأ. ونحن نحتفظ بالحق في رفض طلبات التسجيل، أو تعليق الحسابات، أو إنهائها وفقاً لتقديرنا المطلق؛ ويشمل ذلك الحالات التي نرى فيها أن معلومات التسجيل المقدمة غير صحيحة، أو مضللة، أو تنتهك هذه الشروط والأحكام.

As a user of the ProfileTap platform, you agree to act responsibly, lawfully, and respectfully at all times while using the services. You acknowledge and agree that you are responsible for your own actions, conduct, and any content you upload or share on the Platform. You further agree that you will comply with all applicable laws, rules, and regulations and will not engage in any conduct that:

• Violates any applicable law, regulation, or third-party right (including intellectual property, privacy, and publicity rights).
• Harasses, abuses, threatens, or otherwise harms others or encourages others to engage in criminal behavior.
• Impersonates any person or entity or misrepresents your affiliation with a person or entity.
• Uploads, transmits, distributes, or otherwise makes available any Content that is discriminatory, obscene, defamatory, violent, hateful, or otherwise objectionable.
• Interferes with or disrupts the Platform, servers, networks, or systems of other users.
• Uses the Platform in a manner that could harm, exploit, or degrade any part of the service or any person’s experience. You agree to be solely responsible for your own conduct and the consequences of your actions on the Platform. We reserve the right, with or without notice, to remove any Content, suspend or terminate Accounts, or take other actions we reasonably believe are necessary to enforce this Code of Conduct and protect our users, platform, and services.

ProfileTap may offer certain paid products, services, subscriptions, upgrades, or credits (“Paid Services”). By purchasing or using any Paid Services, you agree to the following terms regarding payment, pricing, and credits:

a. Pricing and Payment Methods:

The prices for Paid Services will be displayed on the Platform at the time of purchase. All fees are denominated in the currency indicated on the Platform and must be paid in full before the Paid Service is activated. You agree to pay all fees and applicable taxes associated with your purchase using the payment methods accepted by ProfileTap.

b. Subscription Billing & Renewal:

If you choose a subscription plan, you authorize us to charge your selected payment method on a recurring basis according to the billing cycle you select (e.g., monthly or annual). Subscriptions automatically renew at the end of each billing period unless canceled according to the cancellation terms on the Platform.

c. Changes to Pricing:

ProfileTap reserves the right to change the pricing for any Paid Services at any time. Price changes will apply to new purchases or renewals after the updated pricing is posted.

d. Credits:

If ProfileTap awards credits (e.g., promotional or account credits), such credits may be applied against future purchases as permitted by the Platform. Credits have no cash value, are non-transferable, and expire if unused as stated on your account or as may be published on the Platform.

e. Refunds & Cancellations:

Unless otherwise specified, all purchases are non-refundable. Refund eligibility, if any, will be determined in accordance with the refund policy published on the Platform. ProfileTap may also suspend or cancel access to Paid Services for non-payment or violation of these Terms & Conditions.

f. Failed Payments:

If a payment cannot be processed (e.g., due to insufficient funds, expired card, or declined transaction), you remain responsible for all amounts due and must update your payment information promptly to avoid service interruption.

You agree to use the ProfileTap Platform and related services only for lawful, ethical, and authorized purposes, and in a manner that does not harm, exploit, or disrupt the Platform or any other user’s experience. You acknowledge and agree that the following activities - which are intended to be illustrative and not exhaustive - are strictly prohibited while using or accessing the Platform:

• Illegal or Unlawful Activities: Using the Platform for any action that violates applicable local, national, or international law, rule, or regulation.
• Security Violations: Attempting to access, interfere with, damage, or disrupt any part of the Platform, including servers, networks, or other users’ data.
• Unauthorized Data Practices: Harvesting, scraping, copying, or collecting data from the Platform or its users without explicit consent, including personal data or metadata.
• Impersonation & Fraud: Impersonating another person or entity, misrepresenting your affiliation with a person or organization, or using the Platform to defraud users or conduct fraudulent schemes.
• Abusive Conduct: Harassing, threatening, or discriminating against other users, or publishing harmful, hateful, defamatory, obscene, or otherwise objectionable content. You agree not to misuse NFC or QR links, scrape or harvest data, circumvent security protections, impersonate others, use bots or automated systems, or use the platform for spam, fraud, or any other unlawful or abusive activity.

We respect your privacy and are committed to protecting your personal information. Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, disclose, and safeguard your personal data. By accessing or using our services, you agree to the terms of the Privacy Policy and consent to our collection and use of your personal information as described therein.

All intellectual property rights in and to the ProfileTap platform, including but not limited to the software, designs, logos, text, graphics, images, audio, video, trade names, trademarks, service marks, domain names, and all other content and materials provided through the Platform (“IP Rights”), are owned by Vedanta Core or its licensors. You agree that these Terms & Conditions do not transfer to you ownership of any IP Rights in the Platform or its content. Except for the limited rights expressly granted herein, no rights, title, or interest in this intellectual property is assigned or licensed to you.

Limited License: You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform solely for your personal or permitted business purposes, in accordance with these Terms & Conditions.

Restrictions: You may not copy, reproduce, modify, distribute, republish, upload, post, transmit, sell, license, create derivative works, reverse engineer, decompile, or otherwise use the IP Rights except as expressly permitted by these Terms or with the prior written consent of Vedanta Core.

Third-Party IP: Any intellectual property owned by third parties and made available on the Platform (e.g., open-source libraries, user-generated content, or embedded content) remains the exclusive property of its respective owner, and your use of such content must comply with its applicable license and terms.

The Platform, Services, Content, and any features or functions made available through ProfileTap are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, ProfileTap, Vedanta Core, and its affiliates disclaim all warranties, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and any implied warranties arising from course of dealing or performance.

No Warranty of Continuous Operation: Neither ProfileTap nor Vedanta Core guarantees that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components, or that any defects will be corrected.

No Liability for Third-Party Content: ProfileTap is not responsible for the content, products, services, or practices of any third parties accessible through the Platform, and you acknowledge that your use of such services is at your own risk.

You agree that your use of the Platform is at your sole risk and that Vedanta Core provides no guarantees regarding the quality, performance, or results of the Platform.

To the fullest extent permitted by applicable law, neither ProfileTap, Vedanta Core, nor its officers, directors, employees, agents, or affiliates shall be liable to you or any third party for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to loss of profits, revenue, data, use, goodwill, or business opportunities, arising out of, related to, or in connection with your access, use, inability to use, or performance of the Platform or services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages. In no event shall the total aggregate liability of ProfileTap, Vedanta Core, and its affiliates for all claims arising out of or relating to these Terms & Conditions or the Platform exceed the total amount of fees actually paid by you for the applicable services during the twelve (12) months preceding the event giving rise to the claim (or INR 0 if no fees were paid).

This limitation of liability shall not apply to (i) damages that cannot be limited or excluded under applicable law, (ii) a party’s gross negligence, willful misconduct, or fraud, or (iii) your indemnification obligations under these Terms & Conditions.

We may suspend or terminate your access to the ProfileTap Platform, your Account, or any part of the services at any time, with or without cause, and with or without prior notice, if we determine, in our sole discretion, that:

• You have violated these Terms & Conditions or any policies referenced herein (including the Acceptable Use Policy).
• You engage in fraudulent, unlawful, or abusive conduct.
• Your use of the Platform creates a security risk, legal liability, or harm to the Platform or other users. You may also choose to terminate your Account at any time by following the account deactivation process on the Platform or contacting us.

Effect of Termination: Upon termination or suspension:

• Your right to access and use the Platform will immediately end or be restricted.
• We may remove or delete your Content and information at our discretion.
• Any unpaid fees or obligations you owe to us remain due and payable.

Survival: Any terms that, by their nature, should survive termination (such as Intellectual Property Rights, Limitation of Liability, Indemnification, Governing Law, and accrued rights) shall continue to apply even after termination.

We reserve the right to update, amend, or modify these Terms & Conditions at any time in our sole discretion for legal, operational, or business reasons. Any material changes will be posted on the Platform with an updated effective date. Your continued use of the Platform after the changes are posted constitutes your acceptance of the updated Terms & Conditions. It is your responsibility to review these Terms regularly to stay informed of any changes. If you do not agree to any updated terms, you must discontinue your use of the Platform.

The Platform may contain links to third-party websites, services, applications, or content that are not owned, controlled, or operated by ProfileTap, Vedanta Core, or its affiliates. These links are provided solely for your convenience and do not imply any endorsement, approval, or affiliation with the third party or its offerings. We do not have control over - and are not responsible for - the content, privacy practices, terms of use, products, services, or practices of any third-party websites, services, or resources. Your interactions and transactions with any third parties accessed through the Platform are solely between you and the third party. You acknowledge and agree that ProfileTap and Vedanta Core shall not be liable for any loss, claim, damage, cost, or liability arising from or related to your use of any third-party links, content, services, or resources.

These Terms & Conditions, including any disputes arising out of or relating to them, shall be governed by and construed in accordance with the laws of India. All disputes arising out of or relating to these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts located in Maharashtra, India.
